- Car Sharing:
- means the sharing of a Vehicle for a Trip by a Driver carrying a Passenger for that Trip in exchange for a
- CARPOOL ARABIA:
- means the people maintaining the car sharing services app and any of its partners or group or associated companies.
- Cost Contribution:
- The amount agreed between the Driver and the Passenger in relation to the Trip which is payable by the Passenger as their contribution towards the costs of the Trip.
- means the person using the App to offer to share a car journey with a Passenger and to transport that Passenger to a given destination at an agreed time in exchange for the Cost Contribution.
- refers to a Passenger, Driver or any other user of the App.
- means a person who has accepted an offer to be transported by a Driver.
- refers to any service provided by the App to any Member.
- the App:
- means CARPOOL ARABIA Mobile Application available on the Apple App Store or
on the Google Play store, operated and owned by CARPOOL ARABIA.
- means a given journey in relation to which a Driver and a Passenger have agreed a transaction through the
- User Account:
- means an account with the App opened by a Member and used in order to access the Service provided by the

2. ABOUT USING THIS APP
These terms apply to any use of the App whatsoever. By accessing the App, you are agreeing to be bound by Conditions in full. If you do not accept the Conditions stated herein, do not use the
3. VARIATION OF THE CONDITIONS, THE SITE AND SERVICES
CARPOOL ARABIA reserves the right to modify the Conditions at any time by updating this posting. You should visit this page periodically to review the Conditions because they are binding on you. In addition, CARPOOL ARABIA may vary or amend the Services provided through the
App, the app functionality and/ or the "look and feel" of the App at any time without notice and without liability.
Any modification to the App, Services or Conditions will take effect as soon as such changes are published on the
4. USER ACCOUNT AND ACCURACY OF INFORMATION
In order to use the Services you must create a User Account and agree to provide any personal information requested by CARPOOL ARABIA. In particular, you will be required to provide your first name, last name, gender, valid telephone number and email address. Use of the
App is limited to those over the age of 21 at the time of registration.
You agree and accept that all of the information you provide to CARPOOL ARABIA when setting up your User Account and at any other time will be true, complete and accurate in all respects. You also agree that any information supplied to CARPOOL ARABIA or posted on the
App in connection with any Trip, Vehicle or Car Sharing will be true accurate and complete.
CARPOOL ARABIA will not be liable to any Member in the event that any information provided by a Member (including for the avoidance of doubt another Member) which is incomplete, inaccurate, misleading or fraudulent.
Unless expressly agreed by CARPOOL ARABIA, you are limited to one User Account. No User Account may be created on behalf of or in order to impersonate another person.
5. SHARING YOUR INFORMATION:
5.1 If we charge you any fees or collect any money from you in relation to any services on the
App, including any sponsorship money, credit or debit card payments will be collected by our payment processor.
5.2 In order for payments to be processed you may need to provide some necessary details to our payment processor. We will tell you about this at the point we collect that information.
5.3 We do not disclose any information you provide via the App to any third parties except:
- As part of our booking process and in order to provide our services information may be passed to a Passenger (if you are a Driver) or to a Driver (if you are a Passenger).
- If we are under a duty to disclose or share your personal data in order to comply with any legal obligation (for example, if required to do so by a court order or for the purposes of prevention of fraud or other crime).
- we may share information with our international partner websites where you have made a booking through the
App with a user of our partner websites or where you have used the App to interact with a third party.
- we may transfer your personal information to a third party as part of a sale of some or all of our business and assets to any third party or as part of any business restructuring or reorganisation, but we will take steps with the aim of ensuring that your privacy rights continue to be protected.
- to protect the rights, property, or safety of Carpool Arabia, the
App's users, or any other third parties. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.
5.4 Other than as set out above, we shall not disclose any of your personal information unless you give us permission to do so.
6. STATUS OF CARPOOL ARABIA
The App and the Services are strictly limited to providing a Service for Drivers and Passengers to car share in a private capacity. The Services may not be used to offer or accept car sharing for profit or in any commercial or professional context.
Drivers may not profit from any Trip. The Service and the Cost Contribution may only be used to discharge the Driver's costs and may not be used to generate any profit for the Driver. The Driver is not entitled to make profit by virtue of the amount of the Cost Contribution, the types of Trips offered by a Driver, the frequency of such Trips or the number of Passengers transported. This applies to all activities, arrangements and Services booked using the
App and any additional services or activities which may be agreed between Driver and Passenger.
All Trips, collection points and destinations must be pre-agreed through the
App in advance. Drivers may not collect any Passengers from any location which has not been pre-agreed with the Passenger through the
You are reminded that using the App in a commercial or professional capacity may invalidated a Driver's insurance. CARPOOL ARABIA's liability is limited in accordance with these terms and in particular CARPOOL ARABIA is not liable in respect of any breach of any agreement between Members or breach by a Member of these Conditions including where any Driver (in breach of these terms) offers Services through the
App in a professional or commercial capacity (thereby potentially invalidating their insurance). It is up to Members to be vigilant in ensuring that services are not provided on a commercial basis.
Neither CARPOOL ARABIA nor the App provide any transport services. The App
is a communications platform for Members to transact with one another. CARPOOL
ARABIA does not interfere with Trips, destinations or timings. The agreement for
car sharing is between the Driver and the Passenger.
7. TYPES OF BOOKING AND PAYMENT
CARPOOL ARABIA offers a free service which allows Members to contact each other to arrange a car share.
CARPOOL ARABIA's service is free of charge for all payment done in Cash for
the Contribution Cost. The Passenger will contact the Driver directly to arrange a car share and any conditions of travel. Members accept that given the nature of the service
Drivers and Passengers will have no recourse to CARPOOL ARABIA for any aspect of
the transaction including in relation to cancellation, last minute changes,
failure by the Driver or the Passenger to turn up or non-payment of the Cost
Contribution. In particular it is the Driver's responsibility to collect payment
from the Passenger at the time of the Trip if the Passenger is using Cash
Payment. If the Passenger entered his Credit Card via the App, then CARPOOL
ARABIA will be in charge to debit the Credit Card of the Passenger and will
credit a CARPOOL ARABIA account for the Driver.
The Driver can withdraw the
money in his account if the account reach 100 AED. Depending on the mean of
money transfer, some transaction charge can be taken (up to 15 AED).
CARPOOL ARABIA will not contact either party and will take no steps whatsoever to manage the booking. The service is managed by Drivers and Passengers.
CARPOOL ARABIA reserves the right to change any aspect of the App or its service which may include adding new services (which may require payment) or withdrawing services.
8. DRIVER AND PASSENGER OBLIGATIONS
Driver Obligations (The Driver Agrees)
That he will present himself on time and at the place agreed with the specified vehicle.
That he will immediately inform all Passengers of any change whatsoever to the Trip. If one or more Passengers have made a booking and the Driver decides to change any aspect of the Trip, the Driver undertakes to contact all Passengers who have made a booking in relation to that Trip and to obtain the agreement of all Passengers to the change.
That he must comply with the Good Conduct Charter at all times.
That he must wait for the Passenger at the pickup point for at least 10 minutes after the agreed time (however, the Passenger is expected to be punctual)
That he will comply at all times with applicable local laws and, specifically, if he is using CARPOOL ARABIA to carpool in the Emirate of Dubai with someone who is not a family member, a friend nor a co-worker, he will obtain and carry at all times any and all necessary permits through the Sharekni.ae portal.
Passenger obligations (The Passenger Agrees
That he will present himself on time and at the place agreed with the Driver.
That he will immediately inform the Driver or CARPOOL ARABIA if he is required to cancel a Trip.
That he will comply with the Good Conduct Charter at all times.
That he will wait at the pickup point for at least 10 minutes after the agreed time for the Driver to arrive.
That he will pay the Cost Contribution to the Driver; and - That he will comply at all times with applicable local laws and, specifically, if he is using CARPOOL ARABIA to carpool in the Emirate of Dubai with someone who is not a family member, a friend nor a co-worker, he will obtain and carry at all times any and all necessary permits through the Sharekni.ae portal.
If the Passenger or Driver fail to comply with any of these terms or any other Conditions CARPOOL ARABIA reserves the right to keep information relating to the breach, to publish or disclose this information on the Member's online profile and to suspend or withdraw the Member's access to the
The Driver agrees and undertakes that he will take out and maintain insurance to cover the Trip and any car sharing offered or booked through the
App. The Driver agrees that he will, on request, provide the Passenger with evidence in advance of the Trip of the complete validity of its insurance policy. The Driver also undertakes to hold a valid driving license and that he will own or will be entitled to use the vehicle and that the vehicle will have a valid UAE car registration certificate and the Passenger is entitled to request evidence of the Driver's insurance, registration certificate, driving license and UAE car registration certificate at any time up to completion of the Trip.
It is CARPOOL ARABIA's understanding that most insurers take the view that a passenger who contributes only towards travel expenses is treated as travelling for free, and is therefore a third party passenger who is covered by compulsory third party insurance in the UAE. However CARPOOL ARABIA gives no warranty or assurance in this regard and it is the Driver's responsibility to verify that his insurance provides adequate cover.
It is up to each Driver and Passenger to confirm with each other that the Driver is covered by valid insurance. The Driver must confirm that his insurance policy allows him to carry passengers and that his insurance policy covers all Passengers and any accident or incident which may occur during a Trip.
The Driver and the Passenger are aware that standard non-commercial insurance policies may refuse to cover loss or damage arising in the event that the Driver had made or was seeking to make a profit.
The Driver may collect no payment from the Passenger other than the Cost Contribution and the Driver must not in any event make a profit.
The Driver therefore undertakes to calculate his expenses (fuel, toll, maintenance, repairs, RTA certificate, depreciation and insurance of their vehicle) and guarantees that the total Cost Contributions requested from his passengers does not result in any profit.
If the Driver does make a profit, or if the insurers repudiate or refuse to accept any claim arising during a Trip for any other reason the Driver will be responsible for the financial consequences, losses and damages arising and CARPOOL ARABIA will not be liable under any circumstances to the Driver or the Passenger.
CARPOOL ARABIA reserves the right to suspend immediately the account of a user including the money displayed and to make aware to competent authorities any professional activity
10. MANAGEMENT OF DISPUTES BETWEEN MEMBERS
CARPOOL ARABIA shall provide its Members with an online communication service between Drivers and Passengers for resolving disputes. This service is non-binding. CARPOOL ARABIA is under no obligation to seek to resolve disputes and this service is offered at CARPOOL ARABIA's sole discretion and may be withdrawn at any time.
11. VERIFICATION OF PHONE NUMBER
In order to increase trustworthiness, prevent typos and wrong numbers, you must verify your mobile number. You should do this by providing CARPOOL ARABIA with your mobile phone number, after which you will receive a SMS with a
3-digit code which can be validated on the App.
This service is free of charge, except for the possible cost levied by your mobile phone operator for receiving the SMS.
CARPOOL ARABIA is not a party to any agreement between a Driver and Passenger and will not be liable to either party CARPOOL ARABIA. More particularly, CARPOOL ARABIA shall not be liable for any loss or damage arising as a result of:
Any inaccurate or incomplete information being provided by a Member
The cancellation of a Trip by a Driver or Passenger
Any failure to make payment of a Cost Contribution
Any fraud, fraudulent misrepresentation or breach of duty or breach of any of
these Conditions by a Driver or Passenger before, during or after a Trip.
CARPOOL ARABIA will not be liable to any member for any business, financial or economic loss or for any consequential or indirect loss such as lost reputation, lost bargain, lost profit, lost of anticipated savings or lost opportunity arising as a result of the services provided by CARPOOL ARABIA (whether suffered or incurred as a result of the CARPOOL ARABIA's negligence or otherwise). Given that Drivers are required to hold valid insurance to cover a Trip and given that CARPOOL ARABIA's service is limited to putting Drivers and Passengers in touch with each other and cannot oversee any Trip Members accept that the limitations on the CARPOOL ARABIA's liability set out above are reasonable.
13. SUSPENSION OR WITHDRAWAL OF APP ACCESS
In the event of non-compliance on your part with all or some of the Conditions, you acknowledge and accept that CARPOOL ARABIA can at any time, without prior notification, interrupt or suspend, temporarily or permanently, all or part of the services or your access to the
App (including in particular your User Account).
14. INTELLECTUAL PROPERTY
All rights are reserved in relation to any registered and unregistered trademarks (whether owned or licensed to CARPOOL ARABIA) which appear on the Site. The contents of the
App, such as text, publications, newsletters, articles, opinions, views, graphics, images, HTML code, multimedia clips, Java code,
objective C code and the selection and arrangement of information may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose.
No party is entitled to systematically extract and/or re-utilise parts of the contents of the
App without the prior written consent of CARPOOL ARABIA. In particular, the use of data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilisation of any substantial parts of this Site is strictly prohibited.
15. CONTENT OF THE APP PROVIDED BY THE MEMBERS
By displaying content on the App, you expressly grant a license to CARPOOL ARABIA to display the content and to use it for any of our other business purposes.
Users of this App are expressly asked not to publish any defamatory, misleading or offensive content or any content which infringes any other persons intellectual property rights (e.g. copyright). Any such content is contrary to CARPOOL ARABIA's policy and CARPOOL ARABIA does not accept liability in respect of such content, and the user responsible will be personally liable for any damages or other liability arising and agrees to indemnify CARPOOL ARABIA in relation to any liability it may suffer as a result of any such content. However as soon as CARPOOL ARABIA becomes aware of infringing content, CARPOOL ARABIA shall do everything it can to remove such content from the
App as soon as possible.
16. CONTENT OF THE SITE PROVIDED BY CARPOOL ARABIA ? LIMITATION OF WARRANTIES
The information contained on the App may contain typographical errors. The content may be changed without notice. THE CONTENT CONTAINED IN THE
APP IS PROVIDED "AS IS" WITHOUT ANY REPRESENTATIONS, WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OR CONDITIONS OF FITNESS FOR A PARTICULAR PURPOSE OR USE, OR NON-INFRINGEMENT. FURTHER, NO REPRESENTATIONS OR WARRANTIES ARE MADE CONCERNING THE ACCURACY, COMPLETENESS, TIMELINESS OR RELIABILITY OF THE CONTENT, OR OF ANY INFORMATION CONTAINED IN ANY SITE LINKED TO
THE APP. CARPOOL ARABIA DOES NOT WARRANT OR GUARANTEE UNINTERRUPTED ACCESS TO THE
APP, ANY SITE LINKED TO THE APP OR TO THE AVAILABILITY OF INTERNET EMAIL LINKS PROVIDED ON THE
APP. IN NO EVENT SHALL CARPOOL ARABIA, ITS OFFICERS, AFFILIATES, AGENTS, LICENSORS, EMPLOYEES OR INTERNET SERVICE PROVIDER(S) BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO LOST REVENUE, LOST OR DAMAGED DATA OR OTHER COMMERCIAL OR ECONOMIC LOSS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER THEORY OF LIABILITY. THE FOREGOING LIMITATION SHALL APPLY EVEN IF CARPOOL ARABIA OR ITS OFFICERS, AFFILIATES, AGENTS, LICENSORS, EMPLOYEES OR INTERNET SERVICE PROVIDER(S) HAVE BEEN ADVISED OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGE.
Absent the use of encryption, the Internet is not a secured medium and privacy cannot be ensured. Internet email is vulnerable to interception and forging. CARPOOL ARABIA will not be responsible for any damages you or any third party may suffer as a result of the transmission of confidential information that you make to any third party through the Internet email links provided on the
App. CARPOOL ARABIA is not responsible for any errors or any changes made to any
transmitted information. Should you decide to transmit information using Internet email links, you do so at your own risk.
18. PARTNER SITES
CARPOOL ARABIA reserves the right to reproduce any information that appears on the
App or on the partner sites.
In particular, ads published on one of the App maintained or co-maintained by CARPOOL ARABIA may be reproduced on other sites maintained or co- maintained by CARPOOL ARABIA or third parties.
The site may contain links to other sites as well as email links. These links are provided solely as a convenience to you. These other sites were independently developed by parties other than CARPOOL ARABIA and CARPOOL ARABIA assumes no responsibility for the accuracy or appropriateness of the information contained in such sites. The inclusion of any link to another site does not imply endorsement by CARPOOL ARABIA. Any mention of another party or its product or service on the website should not be construed as an endorsement of that party or its product service. If you decide to access linked third party websites, you do so at your own risk.
19. COMPUTER VIRUSES
While CARPOOL ARABIA makes reasonable efforts to ensure that all Materials and Services provided on the
App do not contain computer viruses, you are responsible to take the appropriate precautions to scan for
Mobile App viruses and to ensure that you have a complete and current back up of the applicable items contained on your computer system.
20. LAW AND JURISDICTION
These terms shall be governed by the law of the Emirate of Dubai in the United Arab Emirates and any disputes arising in relation to these terms shall be subject to arbitration at the Dubai International Arbitration Centre.
21. PAYMENT & REFUND
All users can pay in Cash or by Credit Card. We accept payments online using Visa and MasterCard credit/debit card in AED. Card will only be debited AFTER confirmation of the reception of the Serivce. In case of error, refunds will be done within 3 days and only through the Original Mode of Payment. If payment is done by credit card, the cardholder must retain a copy of transaction records and Merchant policies and rules.
